Faxmark has been accredited by the Direct Marketing Association of SA as a CENTRE OF EXCELLENCE MEMEBER. We conform to all direct marketing and data base legislation as below:
- The Constitution and Bill of Rights Act 108 of 1996 : Enshrine the right to privacy, giving a person the right to control his personal information and give everyone the right of access to information held by a third party in order to protect any right – section 32(1)(b)
- The Promotion of Access to Information Act no 2 of 2000: where possible, must divulge the source of the information to the person concerned and give the right to amend or opt-out. Not to be divulged to 3rd parties.
- The Promotion of Administrative Justice Act no 3 of 2000 : the right to demand how decisions and processes are arrived at on issues of public or personal importance
- The Electoral Act 1998: prohibits the use of information held in the new the voters roll for marketing purposes.
- The RICA Act: Information captured in terms of the Rica Act is strictly confidential and it is a criminal offence to access it as a database.
- The Identification Act 1997: deals with the protection of personal information held by Home Affairs.
- National Credit Act 34 of 2005: regulates the granting, administration of credit and the sharing of personal information.
- Electronic Communications and Transactions Act no 25 of 2002: Internet, SMS, faxes, telemarketing: must with each communication offer an ‘unsubscribe “or “opt-out” link and on request, divulge the source of the information?
- Consumer Protection Act 68 of 2008: marketers must offer an “opt out”, and it also deals with discriminatory practices which could affect the use of information.
- Protection of Personal Information (PPI) Bill (B9-2009) : Intends to regulate the collection and processing of personal information by both the private and public bodies (including the State)
Opt Out
Each fax carries an "opt out" clause and contact number, enabling recipients who do not wish to receive any further faxmail to have their details removed from our system. Furthermore we only send faxes during daytime hours, from 7am to 7pm, and never over weekends and religious holidays.
